You must be 18 years or older to use this Service.
You must provide your full legal name, current address, a valid email address, and any other information needed in order to complete the signup process.
You are responsible for keeping your password secure. QUIKAF cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
You may not use the QUIKAF service for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws) as well as the laws of India.
You are responsible for all activity and content (data, graphics, photos, links) that is uploaded under your QUIKAF account.
You must not transmit any worms or viruses or any code of a destructive nature.
A breach or violation of any of the Account Terms as determined in the sole discretion of QUIKAF will result in an immediate termination of your services.
We reserve the right to modify or terminate the Service for any reason, without notice at any time.
We reserve the right to refuse service to anyone for any reason at any time.
Your use of the Service is at your sole risk. The Service is provided on an ”as is“ and ”as available“ basis without any warranty or condition, express, implied or statutory.
QUIKAF does not warrant that the service will be uninterrupted, timely, secure, or error-free.
QUIKAF does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You understand that your Content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices.
We may, but have no obligation to, remove Content and Accounts containing Content that we determine in our sole discretion are unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.
QUIKAF does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected.
You expressly understand and agree that QUIKAF shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
In no event shall QUIKAF or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, QUIKAF partners, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
Technical support is only provided to paying account holders and is only available via email and if agreed upon earlier via phone and request ticketing system.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the express written permission by QUIKAF.
Verbal or written abuse of any kind (including threats of abuse or retribution) of any QUIKAF customer, QUIKAF employee, member, or officer will result in immediate account termination.
We do not claim any intellectual property rights over the material you provide to the QUIKAF service.
By uploading images and item description content to QUIKAF.com, you agree to allow other internet users to view them and you agree to allow QUIKAF to display and store them and you agree that QUIKAF can, at any time, review all the content submitted by you to its Service.
The failure of QUIKAF to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service together with the Merchant Agreement that you agree to on the first successful login constitutes the entire agreement between you and QUIKAF and govern your use of the Service, superseding any prior agreements between you and QUIKAF (including, but not limited to, any prior versions of the Terms of Service).
You shall not purchase search engine or other pay per click keywords (such as Google AdWords), or domain names that use QUIKAF or QUIKAF trademarks and/or variations and misspellings thereof.
QUIKAF does not pre-screen Content and it is in their sole discretion to refuse or remove any Content that is available via the Service.

Payment of Fees
There are different payment term options available, and depending on the payment term decided with ShipRocket the merchant has to pay on the pre-decided monthly, quarterly, half-yearly or yearly terms.
The merchant has to pay with-in 7 days from the date of Invoice, or he/she risks the chance of closure/termination of the online store.
All fees are exclusive of all state and central taxes, service, sales tax or other taxes, fees or charges now in force or enacted in the future (“Taxes”).
QUIKAF does not provide refunds.
Cancellation and Termination
Once your account is cancelled all of your Content will be immediately deleted from the Service. Since deletion of all data is final please be sure that you do in fact want to cancel your account before doing so.
We reserve the right to modify or terminate the QUIKAF service for any reason, without notice at any time.
Fraud: Without limiting any other remedies, QUIKAF may suspend or terminate your account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the Site.
Modifications to the Service and Prices
Prices for using QUIKAF are subject to change upon 14 days notice from QUIKAF. Such notice may be provided at any time by posting the changes to the QUIKAF Site (QUIKAF.com) or via an announcement.
QUIKAF reserves the right at any time to time to modify or discontinue, the Service (or any part thereof) with or without notice.
QUIKAF shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Service.
Banned restricted products and services:
You shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force.
Without prejudice to the generality of the above, Ekasta Tech Pvt Ltd (ETPL) does not permit hosting of following items:
“Securities” within the meaning of the Securities Contract Regulation Act, 1956, including shares, bonds, debentures, etc. and/or any other financial instruments/assets of any description. While this does not prevent a share broking firm to host its website with BFRS, the trading of the shares through an e-store made available by BFRS is prohibited.
Living, dead creatures and/or the whole or any part of any animal which has been kept or preserved by any means whether artificial or natural including rugs, skins, specimens of animals, antlers, horns, hair, feathers, nails, teeth, musk, eggs, nests, other animal products of any description the sale and purchase of which is prevented or restricted in any manner by applicable laws (including those prohibited under The Wildlife Protection Act, 1972).
Weapons of any description.
Liquor, tobacco products, drugs, psychotropic substances, narcotics, intoxicants of any description, medicines, palliative/curative substances.
Religious items, including books, artifacts, etc. of any description or any other such item which is likely to affect the religious sentiments of any person.
“Antiquities” and “Art Treasures” in violation of the provisions of the Antiquities and Art Treasures Act, 1972(“the Act”).

Ekasta Tech Pvt Ltd (“We” or “Our” or “Us” or “Company” or “ETPL”) is a company duly incorporated under the provisions of the (Indian) Companies Act, 1956, which provides various technology related services/platforms under the brand name ‘QUIKAF’.
The Platform(s) inter-alia facilitates more comfortable form of e-commerce in relation to
various technology related services including but not limited to logistics management
services/solutions and checkout services (“Services”).
The Services would be made available to such persons who have agreed to become user of the Platform (referred to as “You” or “Your” or “Yourself” or “User”, which term shall also
include persons who are accessing the Platform merely as visitors or who undertakes any of
Reasonable Security Practices:
We have implemented reasonable security practices and procedures that are commensurate
with the information assets being protected and with the nature of our business. While we try
our best to provide security that is commensurate with the industry standards, however because of the inherent vulnerabilities of the internet, we cannot ensure or warrant complete security of all information that is being transmitted to Us.
a) The type of Personal Information (including Sensitive Personal Data or Information) that we collect from the Users;
b) The purpose of collection, means and modes of usage of such Personal Information by the Company;
c) How and to whom the Company will disclose such information;
d) How the Company will protect the Personal Information including Sensitive Personal Data or Information that is collected from the Users; and
e) How Users may access and/or modify their Personal Information.
Personal Information/Sensitive Personal Data:
“Personal Information” means any information that relates to the User, which, either directly or indirectly, is capable of identifying the person concerned. “Sensitive Personal Data or Information” means personal information of a User relating to password; financial information such as bank account or credit card or debit card or other payment instrument details; physical, physiological and mental health condition; sexual orientation; medical records and history; biometric information; any detail relating to the above as provided to or received by the Company for processing or storage. However, any data/information that is freely available or accessible in public domain or furnished under the Right to Information Act, 2005 or any other law shall not qualify as Sensitive Personal Data or Information or Personal Information.

While using our Services, we may collect the following categories of Personal Information from the Users:

• All other personally identifiable information/details as the User may share from time to time (including personally identifiable information/details of the customer/buyer of the User). hereinafter collectively referred to as “User Information”.
In order to avail the Services, the Users may also be required to upload/share certain documents, on the Platform and/or e-mail the same to the Company. Accordingly, the term “User Information” shall also include any such documents uploaded or otherwise provided by the Users. We may also keep records of telephone calls received and made for making
inquiries, orders, or other purposes for the purpose of administration of Services.
We may also receive and/or hold information about the User’s browsing history including the URL of the site that the User visited prior to visiting the Platform as well as the Internet Protocol (IP) address of each User's computer (or the proxy server a User used to access the World Wide Web), User's computer operating system and type of web browser the User is using as well as the name of User's ISP. The Platform may use temporary cookies to store
certain data (that is not Sensitive Personal Data or Information) that is used by Us for the
technical administration of the Platform, research and development, and for User
administration. In addition,
• We do not knowingly collect Personal Information from children; and
Purposes for which the Company may use the Information:
limited for the following purposes:
a) Registration of the User on the Platform;
b) Processing the User’s orders/requests and provision of various Services;
c) Sending timely/periodical updates to the User and its customers;
d) Completing transactions with Users effectively and billing for the products/Services
e) Technical administration and customization of Platform;
f) Ensuring that the Platform content is presented to the Users in an effective manner;
g) Delivery of personalized information and target advertisements to the User;
h) Improvement of Services, features and functionality of the Platform;
i) Research and development and for User administration (including conducting user
j) For purposes of research, analysis, business intelligence, reporting and
improvement/development/advancement of the Company’s business, Platform and/or
k) Dealing with requests, enquiries, complaints or disputes and other customer care related
activities including those arising out of the Users’ request of the Services and all other
general administrative and business purposes;

m) Verification of identity of Users and to perform checks to prevent frauds;

o) To comply with applicable legal requirements and our various policies/terms.
Disclosure and Transfer of User’s Personal Information:
We may need to disclose/transfer User’s Personal Information to the following third parties:
To Government and judicial institutions/authorities, to the extent required:
a) Under the laws, rules, and regulations and/or under orders of any relevant judicial or
b) To protect and defend the rights or property of the Company;
c) To fight fraud and credit risk;
e) When the Company, in its sole discretion, deems it necessary in order to protect its
rights or the rights of others.
The Company may also make all User Information accessible to its employees and data
processors/third party vendors only on a need-to-know basis. All the employees and data
processors/third party vendors, who have access to, and are associated with the processing of User Information, are obliged to respect its confidentiality. However, the Company does not disclose information, individually labelled or aggregated, obtained through Marketplace APIs on behalf of a User to other users or any outside parties, unless required by law.
Non-personally identifiable information may be disclosed to third party ad servers, ad agencies, technology vendors and research firms to serve advertisements to the Users. The Company may also share its aggregate findings (not specific information) based on information relating to the User’s internet use to prospective, investors, strategic partners, sponsors and others in order to help growth of Company's business.
We may also disclose or transfer the User Information, to another third party as part of
reorganization or a sale of the assets or business of Company. Any third party to which the
Company transfers or sells its assets will have the right to continue to use the Personal
Information and/or other information that a User provides to Us.
Links to Third-Party:
The links to third-party advertisements, third party websites or any third-party electronic
communication services (referred to as “Third Party Links”) may be provided on the Platform
which are operated by third parties and are not controlled by, or affiliated to, or associated with the Company, unless expressly specified on the Platform.
If You access any such Third-Party Links, we request You to review the concerned website’s
Security Practices and Procedures:
The Company adopts reasonable security practices and procedures to implement technical,
operational, managerial and physical security control measures in order to protect the Personal Information in its possession from loss, misuse and unauthorized access, disclosure, alteration and destruction. The Company takes adequate steps to ensure that third parties to whom the User Information may be transferred adopt reasonable level of security practices and procedures to ensure security of such Information.
You hereby acknowledge that the Company is not responsible for any intercepted information sent via the internet, and You hereby release Us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.
User's rights in relation to their personal information collected by the Company:
All the information provided to the Company by a User, including Sensitive Personal Data or
Information, is voluntary. User has the right to withdraw his/her/its consent at any time, in
withdrawal of consent will not be retrospective.
Personal Information, the User may exercise these rights by emailing the Company
at email@example.com and communicate the change(s) for updating the Company’s records.
In case the User does not provide his/her information or consent for usage of Personal
Information or subsequently withdraws his/her consent for usage of the Personal Information
so collected, the Company reserves the right to discontinue, in part or full, the Services/associated features and benefits for which the said information was sought.
For how long do the Company keep Personal Information:
Company will retain your Personal Information for as long as needed to fulfil the purpose for which it was collected and for a reasonable period thereafter in order to comply with audit, contractual, technical and legal requirements and/or to resolve any future disputes. We may retain aggregated or de-identified data indefinitely or to the extent allowed by applicable law.
